1. User Eligibility

2. About Apna Uttarakhand & Product Nature

Apna Uttarakhand is an initiative connecting rural farming communities and village collectives across Uttarakhand (including Almora, Munsiyari, Champawat, and Pithoragarh) directly with consumers across India.

Natural Agricultural Produce Disclaimer: Our spices, herbal infusions, and mountain teas are pure, single-origin agricultural commodities harvested traditionally without artificial coloring, synthetic preservatives, or artificial fragrances. You acknowledge that natural variations in aroma intensity, particle size, and seasonal crop color are characteristic of unadulterated artisanal produce and do not constitute a product defect.

3. Pricing, Taxes & Legal Metrology Disclosures

• Currency & Taxes: All prices listed on the website are in Indian Rupees (INR ₹) and are inclusive of all applicable Goods and Services Tax (GST) unless explicitly indicated otherwise.
• Net Weight & Country of Origin: In compliance with the Legal Metrology (Packaged Commodities) Rules, 2011, each product clearly states its net weight (e.g., 25g, 50g, 100g, 250g) and Country of Origin (India).
• Pricing Integrity: While we endeavor to ensure all pricing information is accurate, in the rare event of a typographical error or technical glitch displaying an incorrect price, we reserve the right to cancel the order prior to dispatch and refund any paid amount in full.

4. Orders, Acceptance & Fulfillment

When you submit an order on our platform, you receive an automated order confirmation via email/SMS/WhatsApp. This confirmation acknowledges receipt of your order and does not constitute final legal acceptance. Legal acceptance occurs when the package is verified, invoiced, and handed over to our courier partner with a tracking number.

We reserve the right to decline or cancel any order if:

• The delivery PIN code is unserviceable by all partner courier networks.
• The product is temporarily out of season or unavailable due to harsh weather conditions in the Himalayan hills.
• Suspicion of fraudulent payment, non-receipt of payment, or incomplete shipping addresses.

5. Modes of Payment & Security

Customers may choose from multiple secure payment options:

• Unified Payments Interface (UPI): Google Pay, PhonePe, Paytm, BHIM, and bank UPI apps.
• Cards: Indian and international Visa, MasterCard, RuPay debit and credit cards.
• Net Banking: Over 50 major Indian retail banks.
• Cash on Delivery (COD): Available for selected pin codes subject to verification.

All electronic transactions are processed through RBI-authorized payment gateways utilizing 256-bit encryption. Apna Uttarakhand never stores your card CVV, ATM PIN, or online banking passwords.

6. Intellectual Property Rights

All content on this website, including but not limited to the brand name "Apna Uttarakhand", logo, tagline ("गाँव की सोंधी महक"), photographic imagery of Uttarakhand villages and farmers, product writeups, and software code, is the exclusive intellectual property of Apna Uttarakhand and protected under Indian Copyright and Trademark laws. Unauthorized reproduction, modification, or commercial exploitation is strictly prohibited.

7. Limitation of Liability

To the maximum extent permitted by applicable Indian law:

• Apna Uttarakhand shall not be liable for any indirect, incidental, or consequential damages resulting from the use or inability to use our products or website.
• Our total aggregate liability for any proven claim arising out of a purchased product shall not exceed the actual purchase price paid by the customer for that specific product.
• Health Disclaimers: While our traditional Himalayan herbs and spices have centuries-old culinary and wellness roots, our products are not intended to diagnose, treat, cure, or prevent any medical condition. Customers with medical conditions or pregnant individuals should consult a healthcare professional.

8. Governing Law & Jurisdiction

These Terms shall be interpreted, construed, and enforced in all respects in accordance with the laws of the Republic of India. In the event of any legal dispute, claim, or controversy that cannot be resolved amicably through our Grievance Redressal mechanism, the competent courts located in Dehradun, Uttarakhand, India shall have exclusive jurisdiction.
